 a) Hayle Harbour Update

It was reported that Peveril Securities now owns South Quay and Foundry Yard, but that the
new ownership would have no bearing on the development of the supermarket and that all
restrictions on development and the Section 106 conditions had been passed on as
obligations, although alternative planning applications can be submitted.

It was resolved to write to ING to ask them to liaise formally and fully with Hayle Town
Council, following their failure to notify it regarding the sale of South Quay and Foundry
Yard.

It was reported that the Liaison Group had met; Councillor Rance had attended the meeting
and said she would forward a report by email to all Councillors. The original seven options
for consultation had been whittled down to three or four. Councillors said that the people of
Hayle need several options to consider in a full consultation process.

The requirement for ING to complete a full, credible consultation, including due diligence to
Cornwall Council’s satisfaction, was discussed.

It was resolved to contact Jeremy Content and/or Nicola Stinson at Cornwall Council to ask
for clarification regarding due diligence. 

There was then a discussion regarding the future viability of the harbour and the consultation
process.

Councillor Philp declared an interest before the Council moved to a vote.

Councillors Coombe and Pollard declared an interest [and left the room, 8.28pm].

It was resolved to write to Cornwall Council (Harbours Board) to ask it to clarify and
confirm whether or not it is prepared to become one of the consultation options regarding the
future management of Hayle Harbour.

Councillors Lello, Lyons and Polkinghorne requested that their abstentions in the vote for the
resolution be recorded.
